INTRODUCTION
1.1. This Acceptable Use Policy/Terms of Use outlines the terms governing the use of any HosterCity Networks LTD services, including access to or use of the HosterCity website at www.hostercity.com and my.hostercity.com. By using any HosterCity service or website, you agree to comply with this Acceptable Use Policy, which supplements HosterCity’s terms of business.
2. ACCEPTABLE USE
2.1. Customers shall not use or attempt to use any Service or facility, or any website (“Site”), operated, provided, or made available by HosterCity Networks LTD:
2.1.1. Resource Limits on Shared Hosting: Exceed what HosterCity Networks LTD determines to be ‘normal’ levels of resource utilization (CPU, Memory, Disk, Connectivity/Bandwidth), including but not limited to: a) Long-running website requests; b) Detached processes or scheduled tasks; c) Abnormally high numbers of or sizes of files stored on disk; d) Repeatedly high and/or aggressive access to files stored on disk; e) Serving of large downloadable files; f) Storage of backup files where HosterCity already provides a backup service.
2.1.2. Non-Website or Non-Email Data Storage: As a document or file data store for non-website or non-email data, including but not limited to: a) WebDAV or remote file/disk storage; b) ‘owncloud’ or similar services; c) Storage of backups; d) Storage of data not related to or required by the Service.
2.1.3. Email Limits on Shared Hosting: To send more than 500 emails per account per hour. Emails exceeding this limit will be discarded. During the first 24 hours after account creation, the limit is 10 emails per hour.
2.1.4. Background Processes on Shared Hosting: To run background processes or requests consuming resources for more than 30 seconds.
2.1.5. Frequent Scheduled Tasks on Shared Hosting: To run scheduled tasks more frequently than every 5 minutes.
2.1.6. Insecure Usage: In any insecure manner, such as using insecure website systems or code.
2.1.7. Unfair Resource Utilization: To unfairly utilize resources listed as ‘unlimited’.
2.1.8. Interference with Services: In any way that interferes with, damages, or disrupts, or might reasonably be expected to interfere with, damage, or disrupt any Service, Site, equipment, software, network, or other system or facility used in providing a Service.
2.1.9. Illegal or Fraudulent Use: In any way that is unlawful, illegal, fraudulent, or has any unlawful, illegal, or fraudulent purpose or effect.
2.1.10. Disrepute: In a manner likely to bring HosterCity Networks LTD into disrepute or cause HosterCity Networks LTD or any other person to be listed on any abuse or spam list.
2.1.11. Unsolicited Communication: To transmit, or procure the sending of, any unsolicited or unauthorized advertising, promotional material, or similar communication.
2.1.12. Unauthorized Access: To effect or facilitate any unauthorized access to any Services or systems of HosterCity Networks LTD or any third party.
2.1.13. Malware and Denial of Service: Knowingly to store, transmit, or upload any data or material that: a) Contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or other harmful programs or code designed to adversely affect computer software or hardware operation; b) Is designed to facilitate denial of service activities, directed at HosterCity Networks LTD or others.
2.1.14. Prohibited Content: Knowingly to store, transmit, upload, or facilitate the propagation of any data or material which: a) Advocates, promotes, or assists violence, or any activity contrary to applicable laws; b) Is obscene, offensive, hateful, defamatory, or inflammatory; c) Is fraudulent or misleading; d) Is threatening, abusive, invades privacy, or causes needless anxiety or annoyance; e) Advocates or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age; f) Relates to gambling, betting, lotteries, or financial risk/reward operations; g) Infringes any copyright, database right, trademark, or other proprietary right; h) Breaches any legal duty owed to a third party, such as a contractual duty or duty of confidence; i) Relates to cryptocurrencies like Bitcoin or similar systems.
2.1.15. Prohibited Activities: To effect, conduct, or facilitate any activity involving: a) Internet Relay Chat (IRC); b) Anonymous proxy services; c) Bulk, commercial, unsolicited, or ‘spam’ emailing of any type.
2.2. Customers must take reasonable measures to keep secure all access codes, passwords, and keys issued by HosterCity Networks LTD related to any Services.
3. SUSPENSION AND TERMINATION
3.1. HosterCity Networks LTD will determine, at its discretion, whether there has been a breach of this Acceptable Use Policy. In the event of a breach, HosterCity Networks LTD may take appropriate action.
3.2. Failure to comply with this Acceptable Use Policy constitutes a material breach of the terms governing the provision and use of the Services and Sites. HosterCity Networks LTD reserves the right to take any action deemed appropriate, including: a) Issuing a warning; b) Immediate, temporary, or permanent withdrawal of Services or facilities; c) Immediate, temporary, or permanent blocking or removal of any offending activity, information, or material; d) Legal action for reimbursement of all costs on an indemnity basis (including investigation, administrative, and legal costs) arising from the breach; e) Disclosure of information to law enforcement authorities and taking any other necessary action to comply with applicable law.
HosterCity Networks LTD may issue a notice of any violation of this Acceptable Use Policy and require immediate corrective action.
3.3. HosterCity Networks LTD excludes liability for actions taken in response to breaches of this Acceptable Use Policy.
4. REFUND POLICY
4.1. We offer a 30-Day Money Back Guarantee on hosting plans. If you are not satisfied with our hosting services within the first 30 days, you may request a full refund.
4.2. We do not offer refunds on domain name purchases or SSL certificate purchases
